Public Hearing of
October 6, 2004

I.      CALL TO ORDER - 8:30 p.m.

        Jeremy Downs of GCG Associates, Inc. of Wilmington, the applicant’s engineering firm, reviewed for the Board the changes that had been made on the revised plans for Brookside Estates Phase II.        

        Mr. Downs said that the comments from other town boards and the Planning Board’s, review engineer, P.M.P. Associates of East Bridgewater, had been incorporated into the revised plans.  The most significant change, he said, was a proposal to eliminate a retaining wall by acquiring a temporary grading easement from the abutting property owner.  The easement, he said, had been added to the plans.  Also, at the request of the Planning Board, he said, two 10 foot wide sight easements were added to Parcel A and Lot 17 to allow proper sight distances to be maintained along Main Street.  The easements, he said, will allow brush along Main Street to be maintained as requested by the Police Department.

        Mr. Downs noted that a Plan 12 had been prepared to show work related to the new water main to be installed in Main Street from the existing Elm Street water main up to Brookside Drive.  The size of the main, he said, has been increased from 8 to 12 inches.  Those plans have been submitted to the Water Commissioners for review at their next meeting.  He said that a Notice of Intent for the project has been submitted to the Conservation Commission and that plans will be submitted to the Commission Commission once the wetland line is verified. Also, he said, hydrants have been relocated as requested by Fire Chief Allen Hoyt.

        All of the revisions to the original plan are noted in a September 13, 2004 letter to the Board from Mr. Downs.  Attached to the letter were additional drainage calculations.

        When Mr. Downs was through with his presentation, Mr. Lindquist asked Town Planner Noreen O’Toole, Review Engineer Michael Perrault, and Board members if they had any questions or comments.  Mr. Perrault said that, if there is no street light close to the intersection with Route 27, a light should be placed there for visibility.  Ms. O’Toole asked how many lights there were within the subdivision and was told there were two lights.  She recommended an additional light rather than moving an existing light as suggested by Mr. Downs.

        Gordon Coyle said that he was concerned with the inclusion of Parcel A on the plan which he saw as an attempt to avoid the corner lot requirement in the zoning bylaws.  Applicant Donald Shute said that he would be willing to give Parcel A to the abutter if the Board would prefer it. Mr. Perrault said the subdivision could be approved subject to the conveyance of the parcel either to the abutter or to the town prior to endorsement.  

        Mr. Lindquist asked if any waivers were requested and was advised by Mr. Downs and Mr. Shute that there were no waiver requests.

        Motion to approve the Brookside Estates Phase II Definitive Subdivision plan    subject         to the Board’s standard conditions, the condition that the conveyance of                Parcel A be made to either the direct abutter or the town prior to endorsement and              any other condition recommended by Mr. Perrault in his letter of October 6, 2004:               David Nagle
